Barangaroo Photographic Competition
Terms and Conditions (Updated as at 5
March 2012)
By entering the Barangaroo Photo
Competition, you are agreeing to the following Terms and
Condtions:
1. Promoter
1.1. The promoter
of this competition is the Barangaroo Delivery Authority ABN 94 567
807 277 of Level 21, 201 Kent Street, Sydney NSW 2000 (The
Authority).
1.2. The
Authority reserves the right to cancel this competition at any time
and change these Terms and Conditions without prior notice to any
participant, if this is necessitated by unforeseen circumstances
beyond the Authority's reasonable control.
2. Conditions of Entry
2.1. This
competition commences at 12:00am on 1 December and concludes at
4:00pm on 31 December (Competition Period).
2.2. This
competition will be in monthly phases commencing at 12:00am on the
first day of each calendar month and ending at 4:00pm on the last
day of each calendar month during the Competition Period
(Competition Month).
2.3. No entries
will be accepted after 4:00pm on the final day of each
Competition Month.
2.4. All times
are Australian Eastern Standard Time and Australian Eastern
Daylight Savings Time during daylight savings in NSW.
2.5. This
competition is open to anyone who is a resident of Australia
visiting Barangaroo, except:
a. those involved
in the competition's organisation, other employees, consultants and
individuals employed by organisations involved in the development,
marketing or management of Barangaroo; and
b. the spouse, de
facto spouse, parent, natural or adopted child and sibling (whether
natural or adopted by a parent) of a person referred to in
paragraph 2.5 (a).
2.6. Entrants
must be an individual and not a company or organisation.
2.7. Entrants may
submit one image per Competition Month only.
2.8. Entrants may
enter each Competition Month with a new image.
2.9. Images
submitted for previous Competition Months will not be considered in
future Competition Months and the Authority reserves the right to
remove images that have been re-entered from the competition.
2.10. Entries will not be
returned.
2.11. Entries that are considered
indecent, discriminatory, unlawful, harassing, defamatory,
threatening, harmful, obscene, profane, unduly sexually orientated,
racially offensive or that promote a commercial product or
services, contain objectionable content, are otherwise considered
inappropriate or violate Facebook's terms and conditions (http://www.facebook.com/terms.php?ref=pf)
will be deemed invalid and rejected in the absolute discretion of
the Authority.
2.12. The Authority reserves the
right, at any time, to refuse any entry if it contravenes these
Terms and Conditions or is not deemed to be of sufficient standard
for this competition.
2.13. By submitting an entry, the
entrant confirms that the Barangaroo Delivery Authority may use the
entrants information, including name and contact details, for
future contact and marketing related opportunities.
2.14. By submitting an entry, all
entrants are deemed to have agreed to and will be bound by these
Terms and Conditions.
3. How to Enter
3.1. Images must
be submitted together with an entry form available from www.barangaroo.com/photo.aspx or by
contacting the Authority on 02 9255 1700.
3.2. Images must
be submitted in digital jpeg format, at least 1mb in size.
3.3. Images must
be taken physically upon Barangaroo or from Barangaroo's immediate
surrounds and no other location.
3.4. Images
should be saved with the file name including entrant's name and
Competition Month "(first name) (last name) (month)".
3.5. Photos must
be unpublished.
3.6. Creativity
is welcome however the base image must be a photograph and not
graphic design. The Authority may request the base image to be
provided should this be necessary.
3.7. By
submitting an entry to the competition, the entrant warrants that
he/she is the sole author responsible for taking or otherwise
creating the photograph and that he/she is the owner of the
copyright for all images he/she enters into this competition. Where
photomontage / multiple exposures techniques are used to generate
images, the entrant warrants that he/she is the sole owner of the
copyright in each image.
4. Judging and Prize
4.1. Each
Competition Month offers the prize of one $50 voucher for the Apple
iTunes store.
4.2. Each
Competition Month winner will be completely determined by the
Barangaroo Delivery Authority, taking into account the number of
"likes", comments and shares each image receives on
Facebook.
4.3. To like,
comment or share an image, the public must first have a
Facebook account. To set up a Facebook account, visit http://www.facebook.com/ and to like the
Barangaroo Facebook page visit www.facebook.com/barangaroosydney and select
the "like" button.
4.4. There will
generally only be one winning image per Competition Month. If two
images are determined by the Authority as equal, a tie will be
declared and each entrant will receive a $50 iTunes voucher. If
three or more images are determined equal, the same number of
votes, each tie winning entrant will receive a $30 iTunes
voucher.
4.5. The winner/s
of each Competition Month will be notified via email and within 10
days of the end of the Competition Month.
4.6. Judging is
completely by the Authority. The Authority's
decision on all matters relating to the competition is final, and
no correspondence will be entered into concerning the competition's
judging and organisation. Should the quality of entries fall below
the standard required, the Authority reserves the right not to
award prizes.
4.7. The prizes
are not redeemable for cash.
4.8. The
Authority will not be held liable for any lost entries.
4.9. Prizes will
be sent to the winners via Australia Post. Any loss of prizes by
Australia Post is not the responsibility of the Authority. In that
event, the Authority may or may not, in its absolute discretion,
replace the prize.
4.10. Should a winner wish to
collect their prize from the Authority's office, they must promptly
inform the Authority of their intention to do so and collect their
prize within 10 days of the date that the Authority notifies the
winner in accordance with paragraph 4.5 and during normal business
hours.
5. Future use
5.1. Entrants
retain copyright in their photographs. However, submission of any
entry gives the Authority an unrestricted, non-exclusive,
perpetual, irrevocable and royalty free licence, and right to
sublicense, to use and modify any photograph submitted by the
entrant as part of this competition for any future marketing and
promoting purposes, including public exhibition and publication.
This permission extends to publication and reproduction in media,
posters, reports or other documents prepared by or on behalf of the
Authority as well as on the internet (including the Barangaroo
Facebook page and the Barangaroo website).
6. Permissions and Exclusion of Liability
6.1. By entering
this competition, the entrant warrants that permission has been
obtained from anyone appearing in any entered photos, including
parents of anyone under the age of 18, to the entrant submitting
the photograph as part of this competition and the potential future
use of the photograph by the Authority. Entries that include images
of children (<18 years of age) must comply with all federal and
state government rules and requirements.
6.2. If the
entrant is under the age of 18, a parent or guardian must complete
the relevant section of the entry form and confirm his/her
agreement to these Terms and Conditions.
6.3. The entrant
must ensure that nothing in the photograph or accompanying
description infringes on the intellectual property rights of any
other person or entity.
6.4. By entering
into this competition, the entrant (or where the entrant is a
minor, then the parent or guardian) agrees to indemnify and release
the Authority in respect of any judgement, action, or liability for
all loss, damage or injury to persons or property arising from the
negligence of the entrant (or where the entrant is a minor, then
the parent or guardian) or acceptance of any prize or participation
in this competition or against any breach by the entrant of any
third party intellectual property rights and against any act or
omission of the entrant (or where the entrant is a minor, then the
parent or guardian) commenced by a third party against the
Authority.
6.5. This
competition is in no way sponsored, endorsed or administered by, or
associated with, Facebook. The entrant is providing his/her
information to the Authority and not to Facebook. By entering this
competition, the entrant agrees to release and hold harmless
Facebook from any claims, costs, demands or proceedings by the
entrant relating to this competition.
7. Privacy
7.1. The
Authority will treat any personal information (including name,
address, telephone number, e-mail address) obtained from an entrant
in accordance with the Authority's Privacy Management Plan.
7.2. The entrant
may request access to his or her personal information or request
further details on the Authority's Privacy Management Plan by
